Summer camps in communities of owners

14 de July, 2020

Summer is here and with it comes the time for children's summer camps. Imagine being able to take advantage of those community common areas and keep the children entertained. That they can come and go as they please and with the peace of mind that they are supervised. Many of you have asked us if it is possible to arrange them in the common areas of the urbanisation and what is needed to do so. In this post we try to clear up some doubts of a plan that sounds perfect but that can also lead to debates and disputes. The main focus points are the same as always: money and safety.

“The reality is that this type of camp offers many benefits, helping even to foster neighbourhood relations, taking advantage of the child's own environment... We could list many benefits etc...”, says Jesús Santidrián, lawyer and director of Expansión de Madrid. However, this requires a series of essential measures if you want to have a summer camp in the urbanisation. We'll tell you what they are.

Who pays for the summer camp's expenses?

The most normal thing for the installation of a summer camp, for example, in the gardens of the community, is for the expenses to be paid by the neighbours who are going to make use of the service, since there will be owners, without children, who may be bothered by this activity and want to enjoy the common areas, who also pay. “Since it involves changing a communal element, a unanimous agreement between the owners is necessary,” explains Santidrián.

What things should we include in the agreement?

“The agreement should reflect who is responsible in the event of an accident, avoiding the responsibility of those owners who did not make use of it, and how they will contribute to the camp's costs. In addition, it is very important for the community to require the hired company to have the documentation related to Social Security, to be sure that the monitors are properly hired and to verify that they have accident insurance, civil responsibility insurance and medical insurance”, says Santidrián.

We must be aware that if the service is contracted directly by the community of owners, it will assume responsibility in case of an accident, so it is vital for the community to have multi-risk insurance or at least civil responsibility insurance that covers it in case of an accident. If a group of owners have hired them, they will be directly responsible, so they must also have Civil Responsibility insurance. At Mediterráneo we recommend SECURME, our insurance company specialising in homes and communities.

In these cases, ideally, the opinion of a Property Administrator should always be taken into account. He or she will advise you before making any decisions and will provide you with advice from a trusted insurance broker so you can be protected and prepared.
